These Terms of Use ("Terms") govern your use of www.baciniphotography.com and related pages operated by McCrady Enterprises LLC, doing business as BACINI Photography & Boudoir ("BACINI," "we," "us," or "our"). By using our website you agree to these Terms. If you do not agree, please do not use the site. Photography sessions, products, and destination experiences are also governed by the written session agreement, invoice, or booking terms you receive when you book, and those documents control if they conflict with these Terms.
Use of the website
You may use our website for lawful, personal, non-commercial purposes. You agree not to interfere with the site, attempt to gain unauthorized access, scrape or harvest content or data, use the site to send spam, or use it in any way that violates applicable law.
Intellectual property
All photographs, videos, text, logos, designs, and other content on this website are owned by BACINI or our licensors and are protected by United States and international copyright and trademark law. Every image on this site was created by BACINI and is our copyrighted work. You may not copy, download, reproduce, screenshot, post, distribute, modify, or create derivative works from any content without our prior written permission. Sharing a link to a page is always welcome. Client images shown on this site appear with the client's written permission.
Bookings, retainers, and payments
- Consultations booked through our calendar are complimentary and carry no obligation.
- Retainers reserve your date and time, the session itself, and the editing afterward. Retainers are non-refundable and are separate from any image, package, or product purchase; they do not apply in whole or in part toward image or product selection unless your session agreement states otherwise.
- Mini sessions include no images. Images are purchased separately after you view your edited gallery, with no minimum purchase, at the prices published for that event.
- Full experiences and custom sessions are designed around a portrait package selected in advance, subject to the minimum investment stated when you book.
- Payment plans, where offered, are described in your session agreement.
- Prices are in U.S. dollars and may change without notice, except for bookings already confirmed in writing.
- Rescheduling and weather: outdoor sessions may be moved for weather at our discretion. If a session cannot be held on the reserved date for reasons within our control, your retainer will be applied to a new date.
Destination experiences
Group destination experiences, including our Italy experiences, have their own terms covering deposits, payment schedules, cancellations, travel requirements, and inclusions, which are provided before you reserve a seat. Travel to and from the destination, travel insurance, and personal expenses are the guest's responsibility unless stated otherwise in writing.
Session conduct and safety
We reserve the right to end any session, without refund of the retainer, if a client or guest behaves in a way that is unsafe, abusive, or unlawful. Children are photographed only with a parent or legal guardian present or with the guardian's written consent. Boudoir sessions are for clients 18 years of age or older, and identification may be required.
Model release and use of images
Unless your session agreement says otherwise, we may use images from your session in our portfolio, website, social media, and marketing only with your written permission. Boudoir images are never shared publicly without your explicit, separate written consent, and you may withdraw that consent at any time for future use.
Text messages and communications
By providing your phone number and opting in, you consent to receive text messages from us about your inquiry, booking, and reminders, and occasional promotional messages. Message and data rates may apply. Reply STOP to opt out at any time. See our Privacy Policy for details.
Third-party services
Our website links to and embeds third-party services, including our booking calendar, payment pages, online galleries, and social media. We are not responsible for the content, availability, or practices of those services.
Disclaimers
Our website is provided "as is" and "as available." We make no warranties of any kind, express or implied, about the website or its content, including that it will be error-free or uninterrupted. Photographs shown are examples of our work; every session is unique and results vary.
Limitation of liability
To the fullest extent permitted by law, BACINI and its owners, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the website or our services. Our total liability for any claim relating to a session or product is limited to the amount you paid us for that session or product.
Indemnification
You agree to indemnify and hold harmless BACINI from any claims, damages, or expenses arising from your violation of these Terms or your misuse of our website or content.
Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in Fairfax County, Virginia, and you consent to their jurisdiction.
Changes
We may update these Terms at any time by posting a revised version here. The effective date above shows the latest revision. Your continued use of the website after a change means you accept the revised Terms.
